Wishful Sailing Company is per 26 maart 2003 geregistreerd deelnemer S.G.R. onder deelnemersnummer 2923 en lid van de Hiswa vereniging.  Binnen de grenzen van de SGR garantieregeling vallen in dit programma / op deze website gepubliceerde reizen onder de garantie van de SGR. De SGR-garantie houdt in dat de consument ervan verzekerd is  zijn vooruitbetaalde reisgeld terug te krijgen, als zijn partij door financieel onvermogen de overeengekomen tegenprestatie niet kan nakomen. Voor zover overeenkomst mede het vervoer omvat en de plaats van bestemming reeds is bereikt, wordt zorg gedragen voor de terugreis (SGR - Verplichte teksten versie 2009-09.)

Wishful Sailing probeert met haar voorwaarden eventuele discussies en problemen voor te zijn. Indien je na het lezen van deze voorwaarden nog vragen heeft over je boeking vernemen wij dat graag per telefoon of per e-mail voordat de vakantie plaats vindt. Betalingen aan ons geeft aan dat je onze voorwaarden hebt gelezen en hiermee akkoord bent gegaan.

Op deze site zijn knoppen opgenomen om pagina’s te kunnen promoten of delen op de sociale netwerken Facebook, Twitter en Hyves. Deze knoppen worden gerealiseerd door code die wordt aangeleverd door Facebook, Twitter en Hyves zelf. Deze code plaatst onder meer een cookie.

Op alle overeenkomsten en producten betreffende meezeil, zeezeilcursus, flottieljes en bareboat charter zijn de SGR-regeling van toepassing. Deze voorwaarden kan je aanvragen bij definitieve boeking. Als je er prijs op stelt de reisvoorwaarden eerder te ontvangen kun je contact opnemen met ons kantoor.

Reisorganisatoren aanvaarden geen aansprakelijkheid voor schade of derving van reisgenot van de zijde van huurder in het geval zich bij flottielje varen omstandigheden voordoen waarbij het 'moederschip' de flottielje voor één of meerdere dagen moet verlaten of de flottielje leider niet in staat is de flottielje te begeleiden (bijvoorbeeld vanwege ziekte of schade aan het moederschip). Reisorganisatoren zullen het door huurder betaalde bedrag aan 'meerprijs voor flottielje varen over de periode waarop geen begeleiding heeft kunnen plaatsvinden onmiddellijk en volledig retourneren.
 

Aansprakelijkheid agentschap Wishful Sailing: 

• Wishful Sailing is alleen aansprakelijk voor opzet of grove nalatigheid of plichtsverzuim bij de uitoefening van haar diensten als tussenpersoon / agent. Wishful Sailing opereert alleen als agent c.q. bemiddelaar voor lokale verhuur bedrijven en eigenaren. Wij aanvaarden derhalve geen aansprakelijkheid die redelijker wijze voortvloeit uit verschillen in opgegeven bouwjaar, afmetingen en uitrusting.
•  
• Wishful Sailing handelt uitsluitend als (reis)agent voor lokale verhuur bedrijven en eigenaren. Dat betekent dat Wishful Sailing niet zelf als reisorganisator, chartermaatschappij en/of dienstverlener optreedt, maar dat Wishful Sailing uitsluitend adviseert, informeert en bemiddelt bij de totstandkoming van dienst/ huur overeenkomsten tussen de reiziger enerzijds en een verhuurbedrijf, jacht eigenaar, chartermaatschappij en/of dienstverlener anderzijds.
•  
• Wishful Sailing is zelf geen partij bij die dienstovereenkomst en ook niet verantwoordelijk voor de uitvoering daarvan. Uitsluitend de lokale chartermaatschappij, verhuurmaatschappij, jachteigenaar en/of dienstverlener, met wie de reiziger een dienst/ huur overeenkomst aangaat (al dan niet na bemiddeling door Wishful Sailing), is verantwoordelijk is voor de uitvoering van de gesloten dienst/huur overeenkomst.
•  
• Wishful Sailing aanvaard geen enkele aansprakelijkheid voor verlies, diefstal, letsel of beschadiging ontstaan tijdens de reis- en charterperiode. Wishful Sailing spant zich in om de door haar te verlenen werkzaamheden op het gebied van advies, informatieverstrekking en bemiddeling, zo zorgvuldig mogelijk uit te voeren. Wishful Sailing garandeert evenwel geen resultaat.
•  
• Alle voor Wishful Sailing geldende (opgegeven of overeengekomen) termijnen zijn naar beste weten opgegeven en zullen zoveel mogelijk in acht worden genomen. De lokale eigenaar e/o verhuurbedrijf  e/o partner is volgens contract verantwoordelijk voor jacht en afhandeling en en daar dienen potentiele klachten afgehandeld te worden. Bij voorkeur op locatie voor terugreis naar Nederland of Belgie.
•  
• Indien je huurt met schipper zal dit je niet ontslaan van het doen van borg op locatie. Indien schade duidelijk is ontstaan door de schipper kan de eigenaar besluiten om deze schade te verhalen op de schipper. Alle andere schades zijn voor rekening huurder. Deze borg kun je niet verzekeren via Unigarant (huren met schipper is uitgesloten) maar wel via een Duitse verzekeraar EIS - Sealogy of indien aangeboden via de eigenaar (Damage Waiver). Verzekeringen dien je vooraf te regelen.
•  
• Lokale eigenaar e/o verhuurbedrijf zijn verantwoordelijk voor alle online pijzen, extra's, condities en specificaties. Condities en prijzen contract zijn altijd bindend. Aan getoonde foto's (vaak van moederschip) kunnen geen rechten ontleend worden. De beschreven specificaties dienen aanwezig te zijn. Indien gewenst kunnen wij de eigenaars/ verhuurder specificaties en foto's opvragen voor boeking.

 

• Met de laatste reisinformatie ontvang je ons mobiele nummer. Wij zouden het waarderen indien je ons per SMS kunt berichten dat alles in orde is.
•  
• Indien je problemen en/of onduidelijkheden hebt of ontdekt tijdens de check in verzoeken wij je om - indien je er lokaal niet uitkomt - deze direct maar uiterlijk voor vertrek op de 1e dag aan ons kenbaar te maken. Klachten welke tijdens de check in bekend bij je zijn maar niet per direct aan ons gemeld zijn kunnen wij  niet later in de week of bij terugkomst in behandeling nemen.
•  
• Ook bij problemen bij de check out wordt je verzocht om direct contact met ons op te nemen maar in ieder geval voordat je de haven c.q. jacht verlaat.
•  
• Problemen welke niet bij ons gemeld zijn gedurende de charter periode kunnen wij en nemen wij niet in behandeling bij terugkomst.
•  
• Indien onze partner er niet in slaagt om binnen 24 uur het jacht, of minimaal een vergelijkbaar jacht op de overeengekomen tijd aan te bieden heeft de huurder het recht om het contract eenzijdig op te zeggen op locatie. Bij een 2 weekse trip geld een termijn van 2 x 24 uur. Alle ander claims zijn onrechtmatig tenzij er sprake is van  zware nalatigheid en verwaarlozing door onze partner. Schade aan het jacht en uitrusting welke geen gevolgen hebben voor de zeewaardigheid en veiligheid van het jacht zijn geen reden voor annulatie c.q. compensatie korting van contract en jacht.

Graag benadrukken wij dat dat de uitbraak van Corona een situatie van overmacht was waar Wishful Sailing niet aansprakelijk voor gehouden kan worden voor enige tekortkomingen in nakoming van het oorspronkelijk huurcontract tussen klant en lokale verhuurders (zoals in contract vermeld en beschreven). Gelukkig hebben wij dit toen samen met onze klanten en partners goed kunnen oplossen.

Wishful Sailing (in haar functie als bemiddelaar) zal in alle gevallen van een toekomstig negatief reisadvies om welke reden dan ook samen met klant en verhuurder / eigenaar per contract bekijken of de nieuwe boeking verplaatst kan worden naar een latere datum in 2025/2026 of omzetten naar voucher.  Er zal geen geld teruggestort worden.

 

Aansprakelijkheid Klant: 

Alle in dit programma vermelde prijzen zijn in euro's.

Genoemde prijzen zijn o.v.v. wijzigingen door de eigenaren. Genoemde prijzen en condities in opties zijn geldig t/m verstrijken van de optie termijn.

Bij boeking van dient direct na het ontvangen van de factuur 50% (tenzij anders vermeld in contract) en bij vertrek binnen 6 weken na boeking dient 100% aanbetaald te worden) van de prijs te worden aanbetaald. De resterende 50% dient uiterlijk 6 weken voor vertrek te zijn voldaan. Indien Wishful Sailing Company de vliegtickets voor jullie regelt dienen deze 100% vooruit betaald te worden in verband met direct printen van de tickets.

Indien betalingen achterstallig blijven, behoud verhuurder/eigenaar/ beheerder het recht om het jacht door te verhuren aan een third party. Verhuurder/eigenaar/beheerder behoudt ook het recht om de boeking te annuleren binnen 3 werkdagen vanaf bevestigingsdatum.

Bij annulering van de zijde van de huurder zijn de volgende bedragen verschuldigd: tot 6 weken voor vertrek 50% van de prijs. Binnen 6 weken voor vertrek 100% van de prijs. Annulering dient schriftelijk te geschieden. Met betrekking tot vliegreizen zijn de voorwaarden van de betrokken luchtvaartmaatschappij van toepassing.

Boot verzekeringen: alle jachten zijn in principe WA verzekerd door de eigenaar. Je dient een borg te betalen (afhankelijk lengte schip) welke je 100% terug krijgt indien het jacht schade vrij terugkomt. Je kunt ook het eigen risico van het jacht (indien in bezit van geldig ICC Coastal waters) verzekeren via Unigarant. In dit geval betaal je eenmalig een vergoeding (maximaal 102.00 euro met een eigen risico van 15% van de Borg) welke dekt tegen schadegevallen. Je dient er rekening mee te houden dat je dit eenmalige bedrag niet terug krijgt. Alle verzekeringen zijn van toepassing tot Beaufort 6 en onder normaal gebruik van het jacht. Bij vertrek boven Beaufort 6 in het weerbericht is de boot uitgesloten van verzekering en zal je persoonlijk aansprakelijk gehouden worden voor eventuele schade's. Wishful Sailing Company raadt dan ook ten strengste af om bij dit soort omstandigheden uit te varen.

Huurder is aansprakelijk voor tijdens de huurperiode ontstane schade aan het jacht, voor zover deze schade niet onder de verantwoordelijkheid valt van verhuurder, zoals slijtage, ouderdom, gebreken in het onderhoud e.d. Deze aansprakelijkheid van de huurder is beperkt tot het bedrag van de borgsom m.u.v. nalatigheid of grove schuld.
 

• Het jacht wordt schoongemaakt aangeboden en zal na de charter periode weer schoongemaakt dienen te worden. Deze kosten dien je altijd lokaal te voldoen. Deze kosten kunnen vermeld staan in jouw contract onder beschrijvingen zoals Eindschoonmaak/ Service pack/ Charter Pack / Transitlog maar deze eindschoonmaakkosten zijn altijd exclusief! Indien deze kosten niet vermeld in contract zal je dit niet ontslaan van het voldoen van deze eindschoonmaakkosten op locatie!

Aansprakelijkheid bij boeking. Degene die een reis boekt voor (ook) andere deelnemers is hoofdelijk aansprakelijk voor alle anderen die worden aangemeld. Ten aanzien van minderjarige reizigers moet worden aangetoond dat ouders of voogden toestemming hebben verleend.

Naast bovenstaande voorwaarden is vindt u hieronder de kopie aanvullende Hiswa voorwaarden.

Huur periode:
In geval van overschrijding van de overeengekomen charterperiode kan de verhuurder hiervoor extra kosten in rekening brengen. Een omschrijving van de exacte charterperiode vindt u terug in de reserveringsovereenkomst en voucher. 

Standaard verhuur is van zaterdagmiddag 17:00u met retour op vrijdagmiddag rond 17:00u inclusief laatste overnachting naar zaterdagmorgen 09:00u.

Zeilervaring. Indien ter plaatse wordt bevonden dat een huurder niet over voldoende zeilervaring beschikt, heeft de verhuurder het recht een schipper mee te sturen voor één of meerdere dagen. De kosten hiervan zullen bij de huurder in rekening worden gebracht.

Naast bovenstaande voorwaarden is vindt u hieronder de kopie aanvullende Hiswa voorwaarden. 

De klant dient over voldoende vaar-vaardigheden te beschikken. Indien de klant niet beschikt over een re- levant CWO-diploma (Commissie Watersport Opleiding) of een gelijkwaardig diploma, dit ter beoordeling van de onder- nemer, dan dient de klant in ieder geval de leeftijd van 18 jaar te hebben. Deze leeftijdsgrens van 18 jaar geldt niet ten aanzien van open zeil- en/of motorboten.

De klant is verplicht de inventaris, vermeld op de door de lokale eigenaar/verhuurder aan de klant ter hand te stellen inventarislijst en de bij het vaartuig voor het betreffende vaargebied behorende veiligheidsuitrusting, te controleren op aanwezigheid.

Vóór afvaart dient de klant de conditielijst/ check in papieren voor akkoord te tekenen.

Indien de zich aan boord bevindende inventaris niet overeenstemt met de inventaris vermeld op de inventarislijst dan wel in geval de veiligheidsuitrusting onvolledig of ondeugdelijk is, dient de klant hiervan, vóór afvaart, de lokale eigenaar/verhuurder in kennis te stellen.

De klant gebruikt het vaartuig als een goed huisvader en goed schipper en overeenkomstig de bestemming. De klant mag geen veranderingen in het vaartuig aanbrengen. De klant mag het vaartuig niet in gebruik afstaan zonder schriftelijke toestemming van de lokale eigenaar/verhuurder.

Aan het einde van de huurperiode draagt de klant het vaartuig over aan de lokale eigenaar/verhuurder op de overeengekomen tijd en plaats en in dezelfde staat als waarin hij het ontvangen heeft.

De kosten die direct verband houden met het gebruik van het vaartuig, zoals havengelden, liggelden en kosten voor brandstof en water zijn voor rekening van de klant.

De klant heeft voor het laten verrichten van reparaties toestemming nodig van de lokale eigenaar/verhuurder. De lokale eigenaar/verhuurder betaalt de klant de reparatiekosten terug als gespecificeerde rekeningen terzake worden overlegd.

De kosten van het normale onderhoud en herstel van gebreken zijn voor rekening van de lokale eigenaar/verhuurder.

De klant moet schade van welke aard dan ook, dan wel feiten en/of omstandigheden die redelijkerwijs tot schade kunnen leiden, zo spoedig mogelijk aan de lokale eigenaar/verhuurder mee delen.

De klant moet zich houden aan de aanwijzingen van de lokale eigenaar/verhuurder tot behoud van het vaartuig en tot behoud van de rechten van de lokale eigenaar/verhuurder.

De klant is aansprakelijk voor schade en/of verlies van het vaartuig, voor zover niet gedekt door de verzekering, ontstaan gedurende de tijd dat hij het vaartuig onder zich heeft. De klant is niet aansprakelijk indien hij kan aan- tonen dat de schade en/of het verlies niet door hem of door één van zijn mede-opvarenden is veroorzaakt, dan wel niet aan hem en/of de zijnen is toe te rekenen.

Onder schade wordt tevens verstaan gevolgschade. 2 De klant is volledig aansprakelijk voor de door hem veroorzaakte (gevolg)schade welke niet is verzekerd op grond van de in artikel 8 bedoelde verzekering in geval hij het vaartuig gebruikt in het niet tussen hem en de lokale eigenaar/verhuurder overeengekomen vaargebied.

De klant is volledig aansprakelijk voor schade en kosten, welke niet is verzekerd op grond van de in artikel 8 bedoelde verzekering, die het gevolg zijn van het niet opvolgen van de door de lokale eigenaar/verhuurder gegeven aanwijzingen tot behoud van het vaartuig en tot behoud van de rechten van de lokale eigenaar/verhuurder zoals genoemd in artikel 9 lid 10.

De lokale eigenaar/verhuurder is niet aansprakelijk voor schade aan zaken of voor enig lichamelijk letsel/ongeval tenzij die schade en/of dat letsel/ongeval het directe gevolg is van een gebrek aan het door de lokale eigenaar/verhuurder beschikbaar gestelde vaartuig.

HISWA ARTIKEL 12 - KLACHTEN

Klachten over de uitvoering van de overeenkomst moeten schriftelijk of elektronisch en behoorlijk omschreven en toegelicht, binnen bekwame tijd nadat de klant de gebreken heeft geconstateerd of heeft kunnen constateren, ter kennis worden gebracht van de lokale eigenaar/verhuurder.

Niet tijdig indienen van de klacht kan tot gevolg hebben dat de klant zijn rechten ter zake verliest, tenzij de overschrijding van de termijn in redelijkheid niet aan de klant kan worden tegengeworpen.

Als duidelijk is geworden dat de klacht niet in onderling overleg kan worden opgelost, is er sprake van een geschil.

Charter party conditions for the yachtbooker online booking system for yachtcharter: terug naar boven

The charter party is concluded between the charter company and the charterer, and may be concluded through the intermediary of the agency if need be. Wishful Sailing Company is acting as an agent in this respect.Payment, cancellation
1.  Unless otherwise stated in the charter party, payment of the first instalment, as defined, of the charter price is due within three days of conclusion of the charter party; the balance is due six weeks before the commencement of charter. Payment must be received before the dead-lines indicated.
2. In emergencies the charter company may withdraw within 4 days of conclusion of the charter party. In such a case the charter company undertakes to repay to the charterer without delay any monies already paid (if need be, through the agent).
3. The charterer is strongly recommended to take out a voyage cancellation costs insurance. The charter company or the agent will be pleased to send information about such insurance.

Obligations of the charter company
1. The agreed yacht will be delivered to the charterer in a clean, sailable, sea-worthy condition, and with full tanks.
2. If the agreed yacht cannot be delivered at the date agreed in the charter party (e.g. because of average, un-seaworthiness as a result of an accident in the preceding charter etc) the charter company may deliver an equivalent yacht without prejudice to the warranty claims of the charterer in so far as there are  defects in the replacement yacht.

The charterer warrants and undertakes the following:
1.  to observe the principles of good seamanship.
2. to possess a good command of seamanship and sufficient experience in the command of a yacht or to appoint a responsible skipper with such capabilities. If the charterer or his skipper does not possess the necessary licence or certificate of competence to skipper a yacht of the agreed class, the charter company reserves the right to refuse to hand over the yacht, retaining the charter price, or to appoint a skipper in the name of and for the account of the charterer.
3. to observe the laws of any country he might visit and to report the arrival and departure of the yacht to the harbour master.
4. not to use the yacht for the purposes of business or trade, not to take on board any persons not being a member of his immediate group, not to hand over or hire the yacht to a third party without the written consent of the charter company and not to transport any hazardous goods or materials.
5. not to leave the maritime region of the charter company without the prior written consent of the charter company.
6. not to make any changes to the yacht or its equipment.
7. to handle the yacht and its equipment with care, always to wear sailing shoes when on board, to maintain the log book in a simple form, prior to the commencement of charter to inform himself in detail about the area to be travelled, e.g. currents, and sea level changes during strong winds etc.
8. not to leave the protective harbour if winds over 7 on the Beaufort scale are forecast.
9. to return the yacht in proper working order, in an orderly condition with all equipment properly stowed and with full tanks; failure to do this will mean that the cost of filling the tanks and stowing equipment will be deducted from the deposit.
10. to inform the charter company immediately by phone or telegraph in the event of damage, collision, average or other unusual events. To prepare a written account In the event of damage to the yacht or injury to persons, and to have this countersigned by the harbour-master or doctor.
11. always to have the yacht towed by its own line in the event of average or similar events, and to make no agreement about towing or salvage.
12. to check the condition of the yacht and check that all its equipment and items listed on the inventory are complete, both on taking over and returning the boat (the check list), and to confirm this by means of a signature.
13. to report complaints concerning the yacht without delay to the yacht’s base and to note these in the delivery or return documents. Claims notified at a later date cannot be entertained.
14. where applicable, to sign charter parties required by law or the charter company's own contract forms before taking over the yacht.

Repairs, engines and monitoring of the bilges
1.  Repairs costing over € 100 must have the approval of the charter company. The original of any part replaced must be retained. Payments for repairs necessary as a result of wear and tear will be reimbursed by the charter company on presentation of invoices accompanied by the corresponding receipt.
2. The charterer must check the level of the oil, the cooling water and the bilges each day. The charterer must check the cooling water flow continuously during the charter. Damage due to the motor running dry are not insured under any circumstances, and is for the account of the charterer. The motor must not be used when heeling under sail at over 10º as in such a case oil or water supplies to the engine do not function.

Cancellation by the charterer or reduction of the charter price in the event of late delivery or defects
1. If the charter company fails to provide the yacht, or at least an equivalent replacement yacht at the time agreed in the charter party, the charterer may withdraw from this charter party, but not before 24 hours from the commencement of the charter, and receive full reimbursement of all payments made under this charter party. If the charter period is two or more weeks, the minimum time before which the charterer can withdraw is increased by 24 hours per additional week.
2. All other claims for compensation by the charterer are excluded, except in the case of intent and gross negligence by the charter company. If the charterer does not withdraw from the charter, he may claim for reimbursement of the charter price pro rata for the time for which the charter company failed to hand over the yacht.
3. Damage to the yacht and its equipment which does not prejudice its sea-worthiness and which allow the yacht to continue to be used in a reasonable manner shall not be grounds for withdrawal. A reduction in the charter price in such a case is also excluded.

Charter company’s liability
1. The charter company shall only be liable towards the charterer and his crew for loss or damage arising from intent or gross negligence on the part of the charter company, as well as for damages to life and health or personal injuries, resulting from negligent breach of duty by the charter company or from intentional or negligent breach of duty by a legal representative or assistant of the charter company.
2. The charter company shall not be liable for loss or damage caused by inaccuracies, amendments, mistakes and defects in the ancillary nautical equipment provided, e.g. marine charts, handbooks, compass, radio direction finding equipment etc.
3. Claims by the charterer due to the inability of the yacht for use resulting from damage or total loss caused by the charterer or a third party during the charter shall be excluded.

Agency’s liability
 The agency is only liable as an intermediary for intentional or grossly negligent dereliction of duty in the performance of its services as an intermediary.

Charter party conditions:

Contractual partners The charter party is concluded between the charter company and the charterer, and may be concluded through the intermediary of the agency if need be.

Payment, cancellation
1.  Unless otherwise stated in the charter party, payment of the first instalment, as defined, of the charter price is due within three days of conclusion of the charter party; the balance is due six weeks before the commencement of charter. Payment must be received before the dead-lines indicated.
2. In emergencies the charter company may withdraw within 4 days of conclusion of the charter party. In such a case the charter company undertakes to repay to the charterer without delay any monies already paid (if need be, through the agent).
3. The charterer is strongly recommended to take out a voyage cancellation costs insurance. The charter company or the agent will be pleased to send information about such insurance.

Obligations of the charter company
1. The agreed yacht will be delivered to the charterer in a clean, sailable, sea-worthy condition, and with full tanks.
2. If the agreed yacht cannot be delivered at the date agreed in the charter party (e.g. because of average, un-seaworthiness as a result of an accident in the preceding charter etc) the charter company may deliver an equivalent yacht without prejudice to the warranty claims of the charterer in so far as there are  defects in the replacement yacht.

The charterer warrants and undertakes the following:
1.  to observe the principles of good seamanship.
2. to possess a good command of seamanship and sufficient experience in the command of a yacht or to appoint a responsible skipper with such capabilities. If the charterer or his skipper does not possess the necessary licence or certificate of competence to skipper a yacht of the agreed class, the charter company reserves the right to refuse to hand over the yacht, retaining the charter price, or to appoint a skipper in the name of and for the account of the charterer.
3. to observe the laws of any country he might visit and to report the arrival and departure of the yacht to the harbour master.
4. not to use the yacht for the purposes of business or trade, not to take on board any persons not being a member of his immediate group, not to hand over or hire the yacht to a third party without the written consent of the charter company and not to transport any hazardous goods or materials.
5. not to leave the maritime region of the charter company without the prior written consent of the charter company.
6. not to make any changes to the yacht or its equipment.
7. to handle the yacht and its equipment with care, always to wear sailing shoes when on board, to maintain the log book in a simple form, prior to the commencement of charter to inform himself in detail about the area to be travelled, e.g. currents, and sea level changes during strong winds etc.
8. not to leave the protective harbour if winds over 7 on the Beaufort scale are forecast.
9. to return the yacht in proper working order, in an orderly condition with all equipment properly stowed and with full tanks; failure to do this will mean that the cost of filling the tanks and stowing equipment will be deducted from the deposit.
10. to inform the charter company immediately by phone or telegraph in the event of damage, collision, average or other unusual events. To prepare a written account In the event of damage to the yacht or injury to persons, and to have this countersigned by the harbour-master or doctor.
11. always to have the yacht towed by its own line in the event of average or similar events, and to make no agreement about towing or salvage.
12. to check the condition of the yacht and check that all its equipment and items listed on the inventory are complete, both on taking over and returning the boat (the check list), and to confirm this by means of a signature.
13. to report complaints concerning the yacht without delay to the yacht’s base and to note these in the delivery or return documents. Claims notified at a later date cannot be entertained.
14. where applicable, to sign charter parties required by law or the charter company's own contract forms before taking over the yacht.

Repairs, engines and monitoring of the bilges
1.  Repairs costing over € 100 must have the approval of the charter company. The original of any part replaced must be retained. Payments for repairs necessary as a result of wear and tear will be reimbursed by the charter company on presentation of invoices accompanied by the corresponding receipt.
2. The charterer must check the level of the oil, the cooling water and the bilges each day. The charterer must check the cooling water flow continuously during the charter. Damage due to the motor running dry are not insured under any circumstances, and is for the account of the charterer. The motor must not be used when heeling under sail at over 10º as in such a case oil or water supplies to the engine do not function.

Cancellation by the charterer or reduction of the charter price in the event of late delivery or defects
1. If the charter company fails to provide the yacht, or at least an equivalent replacement yacht at the time agreed in the charter party, the charterer may withdraw from this charter party, but not before 24 hours from the commencement of the charter, and receive full reimbursement of all payments made under this charter party. If the charter period is two or more weeks, the minimum time before which the charterer can withdraw is increased by 24 hours per additional week.
2. All other claims for compensation by the charterer are excluded, except in the case of intent and gross negligence by the charter company. If the charterer does not withdraw from the charter, he may claim for reimbursement of the charter price pro rata for the time for which the charter company failed to hand over the yacht.
3. Damage to the yacht and its equipment which does not prejudice its sea-worthiness and which allow the yacht to continue to be used in a reasonable manner shall not be grounds for withdrawal. A reduction in the charter price in such a case is also excluded.

Charter company’s liability
1. The charter company shall only be liable towards the charterer and his crew for loss or damage arising from intent or gross negligence on the part of the charter company, as well as for damages to life and health or personal injuries, resulting from negligent breach of duty by the charter company or from intentional or negligent breach of duty by a legal representative or assistant of the charter company.
2. The charter company shall not be liable for loss or damage caused by inaccuracies, amendments, mistakes and defects in the ancillary nautical equipment provided, e.g. marine charts, handbooks, compass, radio direction finding equipment etc.
3. Claims by the charterer due to the inability of the yacht for use resulting from damage or total loss caused by the charterer or a third party during the charter shall be excluded.

Agency’s liability
 The agency is only liable as an intermediary for intentional or grossly negligent dereliction of duty in the performance of its services as an intermediary.

Charterer’s liability
1. The charterer shall indemnify the charter company against all civil and criminal consequences of third party claims arising from actions and failures to act on the part of the charterer including all legal costs in the country of delivery and abroad. The charterer accepts the yacht on his own responsibility.
2. If the charterer leaves the yacht at any place other than the agreed location for any reason whatsoever, the charterer shall bear the costs for the return of the yacht by water or by land. If the return of the yacht extends beyond the time period of the charter, the yacht shall be deemed to be returned by the client at the time of its arrival in the agreed harbour.
3. Late return of the yacht and non-usability of the yacht caused by the charterer shall be grounds for claims for compensation by the charter company.
4. Attention is drawn to the fact that conclusion of hull insurance by the charter company does not mean that the charterer is not liable for loss or damage not covered by such insurance, or for loss or damage for which the insurance expressly reserved the right of recourse to the charterer. This applies particularly to damage caused by gross negligence, intent or failure to observe the conditions of the charter party, and for any consequential loss or damage.
5. The conditions of the insurance, which we will gladly provide on request, are an integral part of this contract. The deductible excess for each loss is to be borne by the charterer and may differ from the deposit paid. The deposit will be repaid without delay on the return of the yacht and equipment in good condition. Loss and damage will be off-set against the deposit. Loss and damage not covered by the deposit or the insurance shall be paid without delay by the charterer.
 Conclusion of an extended “Skipper’s liability insurance” (which covers crew’s liability amongst themselves and recovery of losses to the chartered yacht in the event of substantiated gross negligence) and a consequential loss insurance is strongly recommended. The charter company and broker will be pleased to send all necessary documentation.

Miscellaneous/subsidiary agreements/ information / separability clause
1. The charter period may only be extended with the agreement of the charter company. If there should be obvious errors in the invoicing of the charter price and the extras, the charter company and the charterer have the right and the obligation to correct the charter price in line with the valid price list. This does not affect the legality of this contract.
2. All care is taken in the preparation of information, but information is given without guarantee.
3. The invalidity of individual provisions shall not affect the validity of the remaining provisions of the charter party. The parties agree to replace invalid provisions by valid provisions most closely approaching the invalid provisions.

Place of jurisdiction, applicable law.
 All claims relating to the relationship between charterer and agency shall be subject to the law applicable to the registered office of the agency; the place of jurisdiction shall be the registered office of the broker. All claims relating to the relationship between charterer and charter company shall be subject to the law applicable at the registered office of the charter company, and the place of jurisdiction shall be the registered office of the charter company.
